What is a Theft Crime?
A theft crime is a criminal offense that is committed when a person takes another person's property without permission. The unlawful appropriation of property that belongs to another person with the intent of keeping it from him or her is illegal if the person did not consent. It is also illegal if the property is already stolen or if it is in the custody of law enforcement.
Frequently committed theft crimes include but are not limited to auto theft, burglary, car jacking, embezzlement, forgery, grand larceny, identity theft, petty larceny, petty theft, receiving stolen property, robbery and shoplifting.
Explanation of Theft Crime and Its Associated Penalties
A person is most likely to be charged with a theft crime in Texas when suspected of unlawfully taking another person's property. The severity of charges depends on the value of the property stolen. For example, a person who stole property valued below $1,500 will usually be charged with a misdemeanor, while a person who stole property valued over $1,500 will most likely be charged with a felony.
Law enforcement officers also take into consideration other factors before classifying a person's theft crime charges. A person's charges are usually enhanced if he or she has a criminal record, has prior theft crime offenses listed on his or her criminal record, or used a weapon while committing the crime. People convicted of theft crimes in Texas may pay fines, spend time in jail, and/or be placed on probation.
